General Terms and Conditions (GTC) of egocentric Systems GmbH

  1. Scope

These General Terms and Conditions, in their version (“Terms”) valid at the time of ordering , are applicable to all contracts, orders and requests regarding the brokerage of tickets between you (“you” or “customer”) and the egocentric systems GmbH (“egocentric Systems”) application. Deviating terms and conditions of the customer are not accepted, unless egocentric Systems expressly agrees in writing. egocentric Systems GmbH is based at Herweghstraße 4, 01157 Dresden and is represented by its managing director Sven Müller. Registered in the Commercial Register of the District Court of Dresden under HRB 25572.

  1. Parties  

As a commercial intermediary, egocentric Systems arranges tickets for leisure events organised by third parties, in the name and on behalf of the respective organiser. The egocentric Systems is not an organizer and does not offer an event itself, unless it is expressly regulated otherwise.

By ordering tickets, the customer instructs the egocentric Systems to enter into a contract with the customer on behalf of and on behalf of the respective organizer, which is the subject of the dispatch of the tickets to the customer.

The purchase of tickets only creates legal relations between the customer and the respective organiser with regard to the event visit. The customer can see who is the organiser during the ordering process and can also be contacted by egocentric Systems by e-mail at ticketing@egocentric-systems.de. The events are carried out by the respective organizers on their own responsibility. The respective organiser is thus also responsible for the provision and performance of the respective event. It is possible that an organiser may use its own general terms and conditions with regard to the relationship between the customer and the organiser as a result of the purchase of tickets relating to the event, which the customer may have to observe. In particular, the respective organiser may make the access and attendance of the event dependent on the prior acceptance of its general terms and conditions by the customer.

  1. Contract

The customer is guided through the ordering process on the website. By clicking on the button “Order subject to payment” at the conclusion of the ordering process, the customer makes a binding offer for a contract for the purchase of the selected tickets. Before submitting the order, the customer can check his details at any time and correct it if necessary. Before placing his order, the customer must give his consent to the integration of the GTC by ticking the designated field. Orders cannot be changed or withdrawn subsequently.

The Promoter accepts the Customer’s offer by sending him an e-mail with a customer and transaction number on his order. This e-mail will only be sent if and to the extent that the desired order can be executed as desired. Only with this e-mail, with which the organizer accepts the offer of the customer, the contract between the organizer and the customer is concluded.

If problems arise during the ordering process, the customer has the possibility to contact our customer service at any time by e-mail at ticketing@egocentric-systems.de.

  1. Payment modalities and due date

All prices for tickets are gross prices, i.e. the applicable statutory value added tax. As part of the ordering process, shipping and handling costs and other charges incurred by the customer are transparently indicated.

In? Depending on the respective organizer and the technical availability, the customer has different payment options. As a rule, the following payment methods are available to the customer: credit card (Visa, Mastercard), instant bank transfer, PayPal and direct debit.

The respective total price including all costs and fees is due for payment immediately upon submission of the customer’s order. If the customer uses an external payment service provider for this purpose, he may be directed to an external side of the payment service provider as part of the ordering process. If a payment due to incorrect information, lack of account coverage or other reasons for which the customer is responsible is not made or not made in due time, the egocentric systems is entitled to claim additional costs incurred as a result against the customer.

  1. Shipping and Print-at-Home

If the tickets are available and the customer has paid the full purchase price for all tickets ordered by him, the tickets will be sent to the customer by standard letter within 7 working days after the conclusion of the contract. Tickets are sent at the expense and risk of the customer.

The egocentric systems offer the customer to print the purchased tickets directly after the conclusion of the contract and payment of the tickets on his own printer. It is the customer’s responsibility to provide the necessary software and hardware for printing the tickets. The customer will receive the tickets in an e-mail including the corresponding invoice. These tickets must be printed independently before the event. Keeping the tickets on a smartphone is not enough. The customer assures that each of his tickets will be printed only once or destroy any multiple printouts. Each ticket will be scanned before the entrance to the event. If it is determined that the respective ticket has been printed several times and is therefore in circulation more than once, the customer is liable for any damages incurred.

The customer is obliged to check his tickets immediately after their access for their correctness, in particular with regard to the event (name, place, date, time), number of tickets as well as price, category and the specific places. Complaints about faulty tickets must be made immediately after receipt of the shipment. The complaint is made to egocentric Systems (egocentric Systems GmbH, Ticketing, Herweghstr. 4, 01157 Dresden Germany, e-mail: ticketing@egocentric-systems.de).

If the mail has not been delivered within 7 working days of the order, the customer must contact egocentric Systems by e-mail at ticketing@egocentric-systems.de. In the event of a misdelivery, the dispatch of a new ticket can in principle only take place after receipt of the return of the original ticket transmitted to the customer.

  1. Return, loss of tickets and relocation of the event

There is in principle no right to return or return tickets outside of legal obligations. Tickets will only be cancelled by the organiser if the event is cancelled. In the event of a spatial or temporal transfer of an event, the purchased tickets shall remain valid in principle. In such cases, however, the customer is entitled to return his tickets to the organiser in good time before the start of the newly scheduled event. For the return of booked tickets, the customer has these to egocentric Systems GmbH, Ticketing, Herweghstr. 4, 01157 Dresden Germany. The affected customer will receive the Return of the ticket at your own expense and risk to the organizer, at the promoter’s choice, either the ticket price paid or a voucher worth the corresponding ticket price for redemption in the ticket shop of the organizer; Service and shipping charges are non-refundable.

In principle, the egocentric systems do not provide a replacement for lost or destroyed tickets.

  1. Cancellation of the event or changes to venue or time

The egocentric systems are not parties to the organisation of the event for which the customer has booked his tickets. It is therefore exclusively the responsibility of the organiser to cancel events or to relocate them spatially or temporally. In this respect, egocentric Systems does not have an obligation to inform the customer of a cancellation or transfer.

In addition, the egocentric systems do not check the information provided by the organizer for the individual events, in particular location, date, time. A guarantee for the correctness of the information published by egocentric Systems is therefore only within the scope of liability according to clause IX. be taken over.

The customer is obliged to inform himself about the respective event at the organizer, its website or daily press in good time, but at the latest on the day of the event.

  1. Prohibition of resale of tickets

The egocentric systems mediate the tickets exclusively to end customers. A commercial resale of the tickets is prohibited to the customer. The egocentric systems and the respective organizers reserve the right to block the affected tickets in the event of violations of the resale ban and to deny the ticket holder access to the venue without compensation or to to expel him from the venue. It should be noted that the barcode on the tickets can only be read once. Should a private transfer of a ticket take place for non-commercial reasons, in particular in individual cases in case of illness or other prevention of the customer, the new ticket holder must expressly point out the validity and content of these GTC. A transfer is only permitted to this extent, provided that the new ticket holder agrees with the validity of these GTC between him and egocentric Systems.

  1. Notes on the event visit

As a precautionary measure, the egocentric Systems points out that the respective organiser sits in place regulations for each ticket issued. In particular, the organiser has regularly regulated the relationship between the customer and the organiser on the basis of its own general terms and conditions. Violation of this provision or rules, including the house rules of the respective venue, may entitle the Promoter to exclude the Customer from the Event or venue.

The respective organiser may also make the access and attendance of the event dependent on the prior acceptance of its general terms and conditions by the customer.

Please note that a ticket is regularly valid when leaving the venue.

  1. Liability

egocentric Systems is liable for defects in accordance with the applicable statutory provisions.

egocentric Systems is not liable for the accuracy and completeness of the information provided by the organizers on the websites of egocentric Systems. This applies in particular, but not exclusively to data and information about the time of the event, location, viewing possibilities, program or occupation.

All claims of customers for damages are generally excluded. These foregoing and otherwise specified in these General Terms and Conditions

However, limitations and limitations of liability do not apply to claims for damages by the customer arising from injury to life, body or health, from liability for other damages resulting from an intentional or grossly negligent breach of duty of the egocentric Systems or an intentional or grossly negligent breach of duty by a legal representative or vicarious agent of egocentric Systems, as well as for claims for damages of the customer due to the violation of essential contractual obligations ( cardinal duties). An essential contractual obligation in the above-mentioned sense is one whose fulfilment enables the proper execution of the contract in the first place and on whose compliance the customer regularly trusts and may rely. However, in the case of a slightly negligent breach of essential contractual obligations, the liability of egocentric Systems is limited in amount to contractually typical, foreseeable damages.

Liability under the Product Liability Act also remains unaffected.

  1. Right of withdrawal

Insofar as the egocentric systems or the respective organizer offer services in the field of leisure activities, in particular tickets for events, there is no right of withdrawal. The reason for this is that in the case of contracts for the provision of services in connection with leisure activities, where the contract provides for a specific date or period for the provision, there is no right of withdrawal (Section 312g para. 2 Set 1 No. 9 BGB). Any order for tickets is therefore binding immediately after confirmation by the egocentric systems and obliges the customer to accept and pay for the ordered tickets.

  1. Data protection

The egocentric Systems collects personal data of the customer in the context of the processing of the orders and pays particular attention to the provisions of the relevant data protection regulations as well as the Telemedia Act. The data (in particular name, address, e-mail, telephone number, order data) will be processed in the automated procedure to the extent necessary for the establishment, design, execution or modification of the contractual relationship. egocentric Systems transmits this data to third parties entrusted with the execution of the purchase contract, in particular to the organizer, insofar as this is necessary in order to carry out and fulfil the concluded contracts.

  1. Applicable law, place of jurisdiction, place of performance

German law applies to the legal relations between the egocentric system and the customer to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).

If the customer is a merchant, the exclusive place of jurisdiction for all disputes arising from the contractual relationship between the customer and egocentric Systems is the registered office of egocentric Systems in Dresden, Germany. In all other cases, egocentric Systems or the Customer may bring an action before any court competent under legal regulations.

If the customer is an entrepreneur, the sole place of performance for deliveries, services and payments is Dresden. In all other cases, the legal provisions apply.

  1. Final provisions

These General Terms and Conditions remain binding even in the event of legal ineffectiveness of individual points with their remaining parts. In place of the ineffective parts, if available, the statutory provisions shall apply. Insofar as this would constitute an unreasonable hardship for a Contracting Party, the contract as a whole becomes ineffective.

These General Terms and Conditions shall enter into force with immediate effect and supersede all previous terms and conditions of egocentric Systems.
